According to Akshay ‘Under the Shop Act of some states, dual employment is restricted, and a voluntary go-slow or neglect of work can be treated as misconduct which is a ground for termination. IT cos have, in some instances, been treated as factories in which workers are restricted from taking up dual employment. But these provisions do not apply universally.’

The US tech giant Oracle has agreed to pay a $23 million fine for creating a slush fund from which it paid out bribes to win contracts in India, UAE and Turkey. He shared that, the US and Indian approaches are different. “While the US FCPA emphasises on instilling transparency and accountability, the approach under India’s PCA is procedure laden.”

The Corporate Affairs Ministry (MCA) is taking several measures to give a further boost to CSR spending by corporates. The government has relaxed the impact assessment fee cap for CSR projects. This rule change would enable corporates to pay more than ₹50 lakh for impact assessment. Our Co-Founding Partner Sawant Singh said the latest move by the MCA, is likely to give a fillip to CSR activities and make it easier for companies to comply with their CSR obligations. He further shared, ‘Also expenditure booked for impact assessment need not be restricted to ₹50 lakh as a higher 2 percent threshold has been prescribed. These are all steps in the right direction.’
