The Bombay High Court(Court), while deciding a preliminary objection to an application filed for enforcement of a foreign award under Section 47, 48 and 49 of the Arbitration and Conciliation Act, 1996 (Act), held that an application for enforcement of a foreign award can be filed within a period of 12 years from the date when such an award becomes enforceable.

The enactment of the Payments and Settlement Systems Act, 2007 (PSS Act), was a laudable and farsighted move as it not only created a regulatory framework for payment and settlement systems, but also provided guidelines to foster the growth of such systems. The PSS Act designated the Reserve Bank of India (RBI) as the regulatory and supervisory authority, and sections 30 and 31 of the PSS Act enable the RBI to impose penalties and compound offences, respectively.

The Bombay High Court in a recent decision had the occasion to interpret the provisions governing inherited tenancy rights under the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947 (Rent Act) in the context of whether tenancy rights are capable of being inherited by a joint Hindu family. It held that tenancy rights cannot be inherited by a joint Hindu family as a unit.
