Neha Naik is a Partner with the Mumbai office of Phoenix Legal and is a part of the litigation and dispute resolution team. Neha focusses on insolvency and bankruptcy, intellectual property, arbitrations and commercial disputes.
Neha has an in-depth experience of advising Indian as well as foreign clients in pre-litigation strategies and representing in various for a across India.
She also regularly represents resolution professionals, resolution applicants, banking and financial institutions and investors in high value insolvency and bankruptcy cases where she is closely involved in the insolvency process from inception to resolution. Neha also possesses proven expertise in advising and representing clients in complex intellectual property transactions, contractual disputes as well as infringement actions and conducting raids for seizing counterfeit products across various business sectors.
- Represented Oricon Enterprises Limited in an international commercial arbitration to successfully secure an arbitration award in relation to a commercial contractual dispute.
- Represented the Consortium of Lenders of Gitanjali Gems Limited in recovery actions against Gitanjali Gems Limited and Mr. Mehul Choksi.
- Advised and represented Resolution Professionals from Deloitte Touche Tohmatsu India LLP and KPMG India in Corporate Insolvency Resolution Process initiated against corporate debtors wherein the said individuals are appointed as the Resolution Professional under the IBC.
- Represented Edelweiss Asset Reconstruction Company Limited in relation to the Appointment of the Resolution Professional under the IBC before the National Company Law Tribunal, Kolkata.
- Represented Standard Chartered Bank to successfully oppose voluntary insolvency proceedings sought by one its debtors before the NCLT Mumbai and successful admission of various petitions for admission of corporate insolvency resolution processes against its debtors.
- Advised Sojitz Corporation a leading Japanese company in pre-insolvency advice against one of its corporate debtors.
- Advised Saurer Group of Companies in relation to the Intellectual Property due diligence of the entire group of companies.
- Represented Ultratech Cement Limited in obtaining injunctions against infringement of its trademarks in multiple Suits before the Bombay High Court.
- Represented Lupin Limited in obtaining injunctions against infringement of its trademarks in multiple Suits before the Bombay High Court.
- Advised Estee Lauder Intellectual Property and Data Privacy issues in India review of the Local Service Agreement.
