Trinath focusses on the firm’s disputes practice, specifically in the areas of company disputes, energy, engineering, insurance and reinsurance, and recoveries. He has been involved in commercial disputes and arbitrations and has acted for Indian and overseas clients in disputes in India and overseas.

He acts for clients and investors in shareholder disputes, and in the enforcement of arbitral awards and judgments in India. He also represents the largest Indian city gas distribution entities in their disputes with the regulator and the government, and also regularly advises them on regulatory and contentious aspects. Trinath also represents several engineering companies in their disputes arising out of contractual issues, delays in project completion and recoveries. He also advises contractors in their claims against their employers, including in respect of variations, prolongation and defect liability.

Trinath also advises on insurance policy coverage, claims handling, strategy, and represents clients in litigation in the areas of property and energy insurance claims and loss of profits claims, and subrogated recoveries. He also advises clients on structuring critical insurance products, such as structuring the nuclear insurance pool and the policies issued under it by India’s largest insurer.

  • Represented a container terminal operator in its arbitration against a Major Port Trust to rework the terms of a concession following a change in law.
  • Represented a contractor against an Oil and Gas major in complex prolongation claims made by the contractor following changes to scope in the setting up of am oil processing plant.
  • Represented a State government in litigation ensuing from 2 large scale irrigation projects involving environmental litigation, public interest litigation and disclosure issues, where the project size was US$12bn and US$7bn respectively.
  • Represented a group of insurers in their arbitration against an IT major and its US subsidiary, arising out a litigation and settlement in the US, in a first of its kind arbitration under an Errors and Omissions insurance policy in India.
  • Represented an Agrichem major in recovering business interruption losses against its insurer following a fire at its plant.
  • Regularly represents insurers in claims made for construction, engineering and business interruption losses by a variety of insureds.
